ZÁKON

ze dne 24. března 1998,

kterým se doplňuje zákon č. 87/1991 Sb., o mimosoudních rehabilitacích, ve znění pozdějších předpisů

Parlament se usnesl na tomto zákoně České republiky:

Čl. I

Zákon č. 87/1991 Sb., o mimosoudních rehabilitacích, ve znění zákona č. 264/1992 Sb., zákona č. 267/1992 Sb., zákona č. 133/1993 Sb., zákona č. 115/1994 Sb., zákona č. 116/1994 Sb., nálezu Ústavního soudu č. 164/1994 Sb., zákona č. 107/1995 Sb., nálezu Ústavního soudu č. 2/1997 Sb. a zákona č. 134/1997 Sb., se doplňuje takto:

V § 18 odst. 1 se na konci vypouští tečka a připojuje se tento text: "a vojenské báňské oddíly, jejichž příslušníci byli na důlní práce odvedeni od 25. února 1948 do 1. září 1950 a pracovali v dolech nejméně 12 měsíců bez předepsaného pravidelného střídání. Příslušníci vojenských báňských oddílů uvedených ve větě druhé se považují za osoby oprávněné podle § 14 odst. 2, i kdyby nebyli do vojenských báňských oddílů zařazeni na základě rozkazů.".

Čl. II

Přechodná ustanovení

1. Příplatek k důchodu podle § 24 odst. 4 zákona č. 87/1991 Sb., ve znění zákona č. 267/1992 Sb., s přihlédnutím k článku I tohoto zákona, se přizná na žádost nejdříve od splátky důchodu splatné po dni účinnosti tohoto zákona; jde-li o důchody přiznané před 1. lednem 1996, platí přitom § 24 odst. 4 věta druhá zákona č. 87/1991 Sb., ve znění zákona č. 267/1992 Sb.

2. Žádost o odškodnění podle § 29 odst. 4 a 5 zákona č. 87/1991 Sb., ve znění zákona č. 267/1992 Sb., s přihlédnutím k článku I tohoto zákona, lze uplatnit do šesti měsíců ode dne účinnosti tohoto zákona.

Čl. III

Tento zákon nabývá účinnosti dnem vyhlášení.
